THE Superior Court has dismissed the deportation proceedings against a tourist who agreed to depart the commonwealth in two weeks time.

Associate Judge David Wiseman ordered last week that the case against Zhi Hui Li be dismissed.

The dismissal order stated that the court will release the $1,000 bail posted by the defendant on Oct. 6, 2005 and his expired passport will also be released to him.

The judge said “each party shall bear its own fees and cost.”

Assistant Attorney General Kevin Lynch submitted a stipulation and proposed order of dismissal for the respondent after he agreed to voluntarily depart from the commonwealth at his own expense within two weeks after he obtain a valid passport.

The respondent was arrested for overstaying in the CNMI without lawful documents.

The affidavit submitted to court stated that Zhi Hui Li entered Saipan as a long-term tourist on September 29, 2002.

The respondent, who is from China, was issued a permit on Oct. 25, 2002 which expired on Dec. 28, 2002.

The affidavit stated that the respondent did not submit any application to the Division of Immigration for renewal or extension and was never issued a temporary work authorization to work in the commonwealth
